Terms of Service

By accessing livalu.homes, applying for a membership, or using LIVALU Building Development's ("LIVALU," "we," "us") services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, do not use our services.

We reserve the right to modify these terms at any time. Changes take effect immediately upon posting to this site. Continued use of our services constitutes acceptance of the modified terms.

LIVALU provides private residential construction services and a residential oversight membership program ("Residential Care") for homeowners in The Woodlands, TX and the greater Houston area.

Membership services include scheduled inspection visits, property reports, repair tracking, and access to the online member portal. Specific details of each membership plan are described in the Membership Agreement signed between LIVALU and the member.

Construction and remodeling services are subject to separate contracts specific to each project.

Eligibility: Memberships are available to owners of single-family residences in The Woodlands, TX and surrounding areas. LIVALU reserves the right to accept or decline membership applications at its discretion.

Minimum term: All memberships have a minimum 3-month period. After the minimum period, membership continues month-to-month until cancelled with 30 days' written notice.

Payment: Membership fees are billed monthly. Non-payment may result in membership suspension or termination.

Cancellation: To cancel your membership, notify LIVALU in writing at least 30 days in advance. No refunds are issued for the already-paid membership period.

Plan changes: Plan changes take effect on the next billing cycle.

The online member portal is an exclusive tool for active Residential Care members. By using the portal, you agree to:

Maintain the confidentiality of your login credentials and notify us immediately if you suspect unauthorized access. Not share your access with third parties. Use the portal only for its intended purposes related to your membership. Not attempt to access other members' accounts or information.

LIVALU reserves the right to suspend portal access for violation of these terms.

Inspection visits include a complete diagnostic walkthrough and minor repairs up to 1 hour of labor. Additional work is billed at the applicable member rate per your plan.

LIVALU is not responsible for pre-existing conditions not detected during inspections, damage caused by events outside our control (natural disasters, third-party acts), or conditions not reasonably visible during a standard inspection.

LIVALU's recommendations are informational in nature and do not constitute guarantees regarding the future condition of the property.

To the maximum extent permitted by applicable law, LIVALU shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from the use of or inability to use our services.

LIVALU's total liability to you for any claim related to our services shall not exceed the total amount paid by you to LIVALU in the 12 months preceding the claim.

This limitation applies regardless of the legal theory under which the claim is brought.

All content on livalu.homes, including text, images, logos, designs, and reports generated by LIVALU, is the property of LIVALU Building Development or its licensors and is protected by copyright and intellectual property laws.

Inspection reports generated for your property are for your personal use. You may not reproduce, distribute, or commercially use site content without prior written authorization from LIVALU.

LIVALU treats all property information with strict confidentiality. Inspection reports, property photographs, and membership details are not shared with third parties without your consent, except as required by law.

Similarly, you agree to maintain the confidentiality of any proprietary LIVALU information you may become aware of in the course of the membership relationship, including methodologies, systems, and processes.

These Terms of Service are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any dispute arising from or related to these terms or LIVALU's services shall be subject to the exclusive jurisdiction of the courts of Montgomery County, Texas.

The parties agree to attempt to resolve any dispute in good faith before initiating formal legal proceedings.
